Presentation to UN Employees Retiring in Thailand
11 February 2025, Bangkok – On Tuesday, Siam Legal’s Managing Partner, Kert Stavorn, was invited to deliver a presentation to a group of United Nations employees on legal considerations for foreigners retiring in Thailand. His presentation, which lasted over an hour, covered several key topics, including retirement visas, property ownership, fund remittance and taxes, estate planning, and investment opportunities in Thailand.
Retirement Visas in Thailand
Mr. Stavorn began by explaining the different types of retirement visas available for foreign nationals. He highlighted two main options: the Non-Immigrant O-A Visa and the One-Year Retirement Extension of Stay. He also discussed how retirees can obtain these visas, either by applying at a Thai Embassy in their home country or by converting an existing visa while already in Thailand.
Property Ownership and Potential Risks
One of the critical topics discussed was the legal framework for foreign property ownership. Mr. Stavorn clarified that foreign nationals can legally own condominiums in Thailand, which remains the most straightforward option for property ownership. He also pointed out potential risks associated with 30-year renewable leases and the use of a Thai company structure to hold land, which comes with legal restrictions and complexities that require careful consideration.
Fund Remittance, Taxation, and FET Forms
Regarding fund remittance and taxation, Mr. Stavorn emphasized the importance of obtaining a Foreign Exchange Transaction (FET) Form when transferring funds into Thailand. This form is crucial for ensuring that the repatriation of funds after the sale of property is tax-free. It also serves as an official record that the incoming funds comply with Thai legal requirements.
Estate Planning and the Importance of a Thai Will
Mr. Stavorn stressed the importance of estate planning, particularly the need for a separate Thai will for assets in Thailand. He recommended that retirees draft their wills in Thai to ensure clarity under Thai law, with an English translation for reference. Having a well-prepared Thai will can significantly reduce the risk of disputes among heirs and provide a smooth transition of assets.
In this context, the role of certified translators and sworn interpreters is vital. Professionals certified by the Southeast Asian Association of Professional Translators and Interpreters (SEAProTI) ensure that important documents like wills, property contracts, and tax documents are accurately translated and legally valid.
Investment Opportunities in Thailand
In the final part of his presentation, Mr. Stavorn provided insights into investment opportunities in Thailand, covering various options such as Thai equities, managed funds, bonds, and debentures. He advised potential investors to carefully evaluate these opportunities and consult professionals before making investment decisions.
The Role of SEAProTI in Supporting Retirees
The Southeast Asian Association of Professional Translators and Interpreters (SEAProTI) plays a significant role in ensuring the success of events like this by providing certified translators, sworn translators, and interpreters. Their expertise is essential for translating legal documents, including wills, contracts, and tax-related documents, into both Thai and English with high accuracy and legal compliance.
Certified interpreters from SEAProTI also play a key role in facilitating communication during conferences and meetings, helping foreign participants fully understand the complex legal and financial information presented. This ensures that retirees receive accurate information that is crucial for making informed decisions about their future in Thailand.

This presentation attracted significant interest from UN staff and included other distinguished speakers, such as Mr. James Bradley, Chief of Human Resources Management Systems at the United Nations Economic and Social Commission for Asia and the Pacific (ESCAP); Ms. Christine Hofer, Chief of Client Services at the United Nations Joint Staff Pension Fund (JSPF) in New York; and a representative from TISCO Financial Group.
Mr. Stavorn had previously participated as a speaker at the United Nations Asia-Pacific Trade and Investment Week held from November 18th to 22nd. His experience in these events highlights his expertise in providing foreign nationals with the information they need to successfully retire and invest in Thailand, ensuring their legal rights and interests are well protected.

The Southeast Asian Association of Professional Translators and Interpreters (SEAProTI) has officially announced the criteria and qualifications for individuals to register as “Certified Translators,” “Translation Certification Providers,” and “Certified Interpreters” under the association’s regulations. These guidelines are detailed in Sections 9 and 10 of the Royal Thai Government Gazette, issued by the Secretariat of the Cabinet under the Office of the Prime Minister of the Kingdom of Thailand, dated July 25, 2024, Volume 141, Part 66 Ng, Page 100.

ประเด็นการถือครองอสังหาริมทรัพย์ถือเป็นเรื่องสำคัญสำหรับชาวต่างชาติที่ต้องการพำนักระยะยาวในประเทศไทย คุณเกียรติได้ให้ข้อมูลเกี่ยวกับสิทธิในการถือครองคอนโดมิเนียม ซึ่งเป็นอสังหาริมทรัพย์ประเภทเดียวที่ชาวต่างชาติสามารถถือครองกรรมสิทธิ์ได้โดยสมบูรณ์ นอกจากนี้ยังกล่าวถึงข้อควรระวังในการเช่าที่ดินระยะยาวแบบ 30 ปี รวมถึงการถือครองที่ดินผ่านการจัดตั้งบริษัทไทย ซึ่งมีข้อจำกัดทางกฎหมายและความเสี่ยงที่ผู้เกษียณอายุควรพิจารณาอย่างรอบคอบ

ในส่วนของการโอนเงินและภาษี คุณเกียรติได้เน้นย้ำถึงประโยชน์ของการขอเอกสาร Foreign Exchange Transaction (FET) Form ทุกครั้งที่มีการโอนเงินจากต่างประเทศมายังประเทศไทย โดยเอกสารนี้จะช่วยให้การโอนเงินกลับไปยังต่างประเทศหลังการขายอสังหาริมทรัพย์สามารถดำเนินการได้โดยไม่ต้องเสียภาษี นอกจากนี้ยังช่วยยืนยันว่าเงินที่โอนเข้ามานั้นเป็นไปตามข้อกำหนดทางกฎหมายไทย
การวางแผนมรดกและพินัยกรรม
คุณเกียรติยังกล่าวถึงความสำคัญของการจัดทำพินัยกรรมสำหรับทรัพย์สินในประเทศไทย โดยแนะนำให้ผู้เกษียณอายุทำพินัยกรรมแยกสำหรับทรัพย์สินในประเทศไทยโดยเฉพาะ ซึ่งควรเขียนเป็นภาษาไทยเพื่อความชัดเจนในการตีความตามกฎหมายไทย และควรมีการแปลเป็นภาษาอังกฤษเพื่อให้ทายาทหรือผู้เกี่ยวข้องเข้าใจเนื้อหาได้ถูกต้อง การมีพินัยกรรมที่ชัดเจนจะช่วยลดความเสี่ยงในการเกิดข้อพิพาทในอนาคตได้

ในกิจกรรมดังกล่าว บทบาทของนักแปลรับรอง ผู้รับรองการแปล และล่ามรับรองที่เป็นสมาชิกของสมาคมวิชาชีพนักแปลและล่ามแห่งเอเชียตะวันออกเฉียงใต้ (SEAProTI) มีความสำคัญอย่างยิ่ง โดยเฉพาะในการแปลเอกสารสำคัญ เช่น พินัยกรรม สัญญาซื้อขายอสังหาริมทรัพย์ หรือเอกสารเกี่ยวกับภาษี ที่ต้องมีความถูกต้องทั้งในเชิงภาษาและเนื้อหาทางกฎหมาย
นอกจากการแปลเอกสารแล้ว ล่ามรับรองที่ผ่านการรับรองจาก SEAProTI ยังมีบทบาทในการช่วยอำนวยความสะดวกด้านการสื่อสารในระหว่างการประชุมและการบรรยาย ล่ามเหล่านี้ช่วยให้ผู้เข้าร่วมชาวต่างชาติเข้าใจเนื้อหาได้อย่างครบถ้วน ไม่ว่าจะเป็นข้อมูลด้านกฎหมาย การลงทุน หรือการจัดการมรดก ซึ่งล้วนเป็นข้อมูลที่ซับซ้อนและต้องการการถ่ายทอดอย่างแม่นยำ
