According to the Announcement of the Office of the Board of Investment No. Por. 5/2547, “Games” under Digital Content for Software is defined as entertainment software that operates on various devices, including graphics and programming, with rules and conditions that players can follow. Examples of such games include Windows-based games, mobile platform games, console games, PDAs, online games, and Massive Multiplayer Online Games (MMOG). However, businesses that provide online gaming services only, without involvement in the software development process, are not eligible for this promotion.
Conditions and privileges provided under this promotion
The conditions for receiving the BOI promotion for the software game activity are as follows:
- The minimum investment must be at least 1 million baht, excluding the cost of land and working capital of the company.
- The debt-to-equity ratio must not exceed three to one for a newly established project.
- The project must include software development processes specified by the Software Industry Promotion Agency (SIPA).
- If the project has an investment capital of 10 million baht or more, it must obtain a quality standard certificate from SIPA or receive a Capability Maturity Model Integration (CMMI) certificate or an equivalent within two years from the start-up date.
As for the privileges, companies that qualify for this promotion will receive several benefits:
- Exemption from import duties on machinery for all zones.
- Eight-year corporate income tax exemption for all zones, with no cap on the amount of exemption.
- Other relevant location-based incentives.

ความหมายของ “เกม” ที่ได้รับการส่งเสริมจาก BOI
ตามประกาศของ BOI เกมที่ได้รับการส่งเสริมในหมวดนี้จะหมายถึงซอฟต์แวร์ที่มีไว้เพื่อความบันเทิง ซึ่งสามารถทำงานบนอุปกรณ์ต่าง ๆ เช่น คอมพิวเตอร์ที่ใช้ระบบปฏิบัติการ Windows โทรศัพท์มือถือ คอนโซล หรือเกมออนไลน์ประเภทต่าง ๆ ที่มีกราฟิกและโปรแกรมมิ่งพร้อมทั้งกฎกติกาที่ผู้เล่นสามารถเข้าใจและเล่นได้ การให้บริการเกมออนไลน์อย่างเดียวโดยไม่มีการพัฒนาซอฟต์แวร์จะไม่ได้รับการส่งเสริมจาก BOI ดังนั้นการพัฒนาเกมและการออกแบบซอฟต์แวร์นั้นจึงเป็นส่วนสำคัญที่ทำให้ผู้ประกอบการมีสิทธิ์ได้รับการส่งเสริมจาก BOI
เงื่อนไขและสิทธิประโยชน์จากการส่งเสริมกิจกรรมซอฟต์แวร์เกม
สำหรับเงื่อนไขการได้รับการส่งเสริมจาก BOI นั้นมีข้อกำหนดที่ค่อนข้างชัดเจน เช่น การลงทุนขั้นต่ำจะต้องไม่น้อยกว่า 1 ล้านบาท โดยไม่รวมค่าที่ดินและทุนหมุนเวียนของบริษัท นอกจากนี้อัตราส่วนหนี้สินต่อทุนสำหรับโครงการใหม่จะต้องไม่เกิน 3 ต่อ 1 โครงการที่จะได้รับการส่งเสริมต้องมีขั้นตอนการพัฒนาซอฟต์แวร์ที่ตรงตามข้อกำหนดของหน่วยงานส่งเสริมอุตสาหกรรมซอฟต์แวร์ (SIPA) และหากโครงการมีมูลค่าการลงทุน 10 ล้านบาทขึ้นไป จะต้องได้รับการรับรองมาตรฐานคุณภาพจาก SIPA หรือจากมาตรฐานคุณภาพระดับสากลภายใน 2 ปีหลังจากเริ่มดำเนินการ
สิทธิประโยชน์ที่บริษัทได้รับจากการส่งเสริมนี้ ได้แก่ การยกเว้นภาษีศุลกากรสำหรับเครื่องจักร การยกเว้นภาษีเงินได้นิติบุคคลเป็นระยะเวลา 8 ปีโดยไม่จำกัดวงเงิน และสิทธิประโยชน์อื่น ๆ ตามพื้นที่ตั้งของบริษัท
